.والنكاح فى الاسلام له نظم وقوانين ويترتب عليه حقوق وواجبات

فمن قوانينه تحريم زوجات الاباء مع انواع اخرى غيرهن

قال تعالى: (وَلاَ تَنكِحُواْ مَا نَكَحَ آبَاؤُكُمْ مّنَ النّسَآءِ إِلاّ مَا قَدْ سَلَفَ إِنّهُ كَانَ فَاحِشَةً وَمَقْتاً وَسَآءَ سَبِيلاً) [سورة: النساء - الأية: 22]

قال الاشعث بن سوار توفى ابو قيس وكان من صالحى الانصار

فخطب ابنه قيس امرأة ابيه فقالت :انى اعدك ولدا ولكنى أاتى رسول

الله صلى الله عليه وسلم أستأمره فأتته فأخبرته فانزل الله تعالى هذه

الايه( وَلاَ تَنكِحُواْ مَا نَكَحَ آبَاؤُكُمْ ) القرطبى

قال تعالى: (يَا أَيّهَا الّذِينَ آمَنُواْ لاَ يَحِلّ لَكُمْ أَن تَرِثُواْ النّسَآءَ كَرْهاً وَلاَ تَعْضُلُوهُنّ لِتَذْهَبُواْ بِبَعْضِ مَآ آتَيْتُمُوهُنّ إِلاّ أَن يَأْتِينَ بِفَاحِشَةٍ مّبَيّنَةٍ وَعَاشِرُوهُنّ بِالْمَعْرُوفِ فَإِن كَرِهْتُمُوهُنّ فَعَسَىَ أَن تَكْرَهُواْ شَيْئاً وَيَجْعَلَ اللّهُ فِيهِ خَيْراً كَثِيراً) [سورة: النساء - الأية: 19]

قال ابن جريج :قال عكرمة :نزلت فى كبيشه بنت

معن بن عاصم بن الاوس

حيث توفى عنها ابو قيس بن الاسلت فجنح عليها ابنه (ضمها الى

نفسه ) فجاءت رسول الله صلى الله عليه وسلم فقال :

يارسول الله لا انا ورثت زوجى ولا أنا تركت فانكح

فأنزل الله هذه الايه (لا يحل لكم ان ترثوا النساء كرها )

وجعل الاسلام لتعدد الزوجات حدا وشروطا :اما الحد فأربع

واما الشروط فالعدل بينهن والنفقة عليهن واحسان عشرتهن واعداد المسكن لكل منهن
هذا مع تحمل الزوج كأب لكل نفقات الابناء وتربيتهم تربية سليمة

فاضلة والا فذنبه عند الله كبيرا

قال تعالى: (وَإِنْ خِفْتُمْ أَلاّ تُقْسِطُواْ فِي الْيَتَامَىَ فَانكِحُواْ مَا طَابَ لَكُمْ مّنَ النّسَآءِ مَثْنَىَ وَثُلاَثَ وَرُبَاعَ فَإِنْ خِفْتُمْ أَلاّ تَعْدِلُواْ فَوَاحِدَةً أَوْ مَا مَلَكَتْ أَيْمَانُكُمْ ذَلِكَ أَدْنَىَ أَلاّ تَعُولُواْ) [سورة: النساء - الأية: 3]

قال الضحاك والحسن وغيرهما ان الاية

السابقة ناسخة لما كان فى الجاهلية وفى اول الاسلام من ان للرجل

ان يتزوج من الحرائر ماشاء فقصرتهن الأية على اربع )

عن الحارث بن قيس قال :اسلمت وعندى ثمانى نسوة فذكرت ذلك

للنبى صلى الله عليه وسلم فقال (اختر منهن اربعا ) رواه ابو داود

واخرج مالك فى موطئه والنسائى والدارقطنى فى سننهما ان النبى

صلى الله عليه وسلم قال لقيلان بن امية الثقفى وقد اسلم وتحته عشر

نسوة (اختر منهن اربعا وفارق سائرهن )

تنظيم الاسلام للزواجقال تعالى: (وَلَن تَسْتَطِيعُوَاْ أَن تَعْدِلُواْ بَيْنَ النّسَآءِ وَلَوْ حَرَصْتُمْ فَلاَ تَمِيلُواْ كُلّ الْمَيْلِ فَتَذَرُوهَا كَالْمُعَلّقَةِ وَإِن تُصْلِحُواْ وَتَتّقُواْ فَإِنّ اللّهَ كَانَ غَفُوراً رّحِيماً) [سورة: النساء - الأية: 129]

قال تعالى: (يَأَيّهَا الّذِينَ آمَنُواْ قُوَاْ أَنفُسَكُمْ وَأَهْلِيكُمْ نَاراً وَقُودُهَا النّاسُ وَالْحِجَارَةُ عَلَيْهَا مَلاَئِكَةٌ غِلاَظٌ شِدَادٌ لاّ يَعْصُونَ اللّهَ مَآ أَمَرَهُمْ وَيَفْعَلُونَ مَا يُؤْمَرُونَ) [سورة: التحريم - الأية: 6]

: وقال صلى الله عليه وسلم (كفى بالمرء اثما ان يضيع من يقوت)ابوداود
وقال تعالى فى شأن نفقة الزوج على زوجته سواء اكانت فى عصمته

ام مطلقة رجعية قال تعالى: (الرّجَالُ قَوّامُونَ عَلَى النّسَآءِ بِمَا فَضّلَ اللّهُ بَعْضَهُمْ عَلَىَ بَعْضٍ وَبِمَآ أَنْفَقُواْ مِنْ أَمْوَالِهِمْ) [سورة: النساء - الأية: 34]

قال تعالى: (لِيُنفِقْ ذُو سَعَةٍ مّن سَعَتِهِ وَمَن قُدِرَ عَلَيْهِ رِزْقُهُ فَلْيُنفِقْ مِمّآ آتَاهُ اللّهُ لاَ يُكَلّفُ اللّهُ نَفْساً إِلاّ مَآ آتَاهَا سَيَجْعَلُ اللّهُ بَعْدَ عُسْرٍ يُسْراً) [سورة: الطلاق - الأية: 7]

قال تعالى: فى حق سكنى المرأة (أَسْكِنُوهُنّ مِنْ حَيْثُ سَكَنتُم مّن وُجْدِكُمْ [سورة: الطلاق - الأية: 6] .. وجدكم – قدرتكم

وقال تعالى مبينا ان نفقة الاولاد الصغار على ابائهم حسب قدرتهم :
قال تعالى: (وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلاَدَهُنّ حَوْلَيْنِ كَامِلَيْنِ لِمَنْ أَرَادَ أَن يُتِمّ الرّضَاعَةَ وَعلَى الْمَوْلُودِ لَهُ رِزْقُهُنّ وَكِسْوَتُهُنّ بِالْمَعْرُوفِ لاَ تُكَلّفُ نَفْسٌ إِلاّ وُسْعَهَا لاَ تُضَآرّ وَالِدَةٌ بِوَلَدِهَا وَلاَ مَوْلُودٌ لّهُ بِوَلَدِهِ وَعَلَى الْوَارِثِ مِثْلُ ذَلِكَ فَإِنْ أَرَادَا فِصَالاً عَن تَرَاضٍ مّنْهُمَا وَتَشَاوُرٍ فَلاَ جُنَاحَ عَلَيْهِمَا وَإِنْ أَرَدتّمْ أَن تَسْتَرْضِعُوَاْ أَوْلاَدَكُمْ فَلاَ جُنَاحَ عَلَيْكُمْ إِذَا سَلّمْتُم مّآ آتَيْتُم بِالْمَعْرُوفِ وَاتّقُواْ اللّهَ وَاعْلَمُوَاْ أَنّ اللّهَ بِمَا تَعْمَلُونَ بَصِيرٌ) [سورة: البقرة - الأية: 233]

ومن الاحاديث

..-عن عمرو بن الاحوص الجشمى رضى الله عنه انه سمع النبى

صلى الله عليه وسلم فى حجة الوداع يقول فى خطبة طويلة له الا ان

لكم على نسائكم حقا ولنسائكم عليكم حقا فحقكم عليهن ان لا يوطئن

فرشكم من تكرهون ولا يأذن فى بيوتكم لمن تكرهون وحقهن عليكم

ان تحسنوا اليهن فى كسوتهن وطعامهن )الترمذى

وقال صلى الله عليه وسلم (خيركم خيركم لاهله وانا خيركم لاهلى ) الترمذى عن عائشة
وقال صلى الله عليه وسلم (خيركم خيركم للنساء )الحاكم عن ابن عباس
مما سبق نجد ان الاسلام اولى العناية

الكاملة للنساء وجعلها لا فرق بينها وبين الرجل الا بالعمل الصالح

وانها تمتلك من الحقوق مثل ما عليها من واجبات

ومن هنا تبرز مكانة المرأة وكونها صانعة اجيال مثلها مثل الرجال
