..........اليوم نكمل ما بدأناه فى موضوعنا السابق

.......وبعد العدة من الطلقتين الاوليين -منع الاسلام اهل المرأة من الوقوف فى وجهها اذا ارادت ورضيت العودة لمطلقها لانه اولى بها ....هذا هو ديننا
....قد حرص الاسلام على اعطاء المرأة المطلقة جميع حقوقها المالية ..قال تعالى (وان اردتم استبدال زوج مكان زوج وأتيتم احداهن قنطارا فلا تأخذوا منه شيئا أتأخذونه بهتانا واثما مبينا)النساء20

اما انواع الفراق الاخرى فنظمها الاسلام بما لا يدع مجالا لظلم او حرمان
**ففى الايلاء (وهو حلف الرجل الا يقرب امرأته)جعل الشارع له نهاية هى اربعة اشهر فاما ان يعود فى نهايتها واما ان يجبر على الطلاق
قال تعالى (للذين يؤلون من نسائهم تربص اربعة أشهر فان فاءوا فان الله غفور رحيم وان عزموا الطلاق فان الله سميع عليم )البقرة227
وكان الايلاء فى الجاهلية السنة والسنتين واكثر من ذلك
...**وفى الظهار --جعل الله كفارة تحل بها المرأة لزوجها ورفع التحريم المؤبد
قال تعالى (قد سمع الله قول التى تجادلك فى زوجها وتشتكى الى الله والله يسمع تحاوركما ان الله سميع بصير الذين يظاهرون منكم من نسائهم ما هن امهاتهم ان امهاتهم الا اللائى ولدنهم وانهم ليقولوا منكرا من القول وزورا وان الله لعفو غفور)المجادلة1-2
.....**وفى الخلع --وهو فراق الزوج الزوجة مقابل مبلغ تدفعه لزوجها
نظم الاسلام حدوده فذكر ان سبب اباحته خوف المرأة الا تقوم بحق زوجها لبغضها له او لأى سبب اخر
وقد يتريب على ذلك وقوع الزوجين فيما حرم الله من تقصير احدهما او كليهما فى حق الاخر وحينئذ يجوز للمرأة ان تدفع لزوجها مالا او تتنازل له عن حقوقها المالية كلها او بعضها كباقى الصداق او النفقة المستحقة او دين اخر عليه
...وفى هذا يقول الله تعالى (ولا يحل لكم ان تأخذوا مما أتيتموهن شيئا الا ان يخافا ألا يقيما حدود الله فان خفتم ألا يقيما حدود الله فلا جناح عليهما فيما افتدت به )البقرة228

وبذلك تدرك مدى ما فى تشريع الاسلام من يسر ورحمة وتخفيف
